terms & Conditions
Last updated: August 2026
These Terms & Conditions apply to products and services supplied under the tinyTour name by Owen Davies Consultant Limited (“tinyTour”, “we”, “us” or “our”).
tinyTour products and services are designed for businesses, charities, trusts and other organisations operating museums, historic houses, gardens, visitor attractions and similar venues.
1. Orders and quotations
Our website provides an overview of tinyTour products and indicative pricing. The exact specification for your system will be confirmed in your quotation or order confirmation.
An order is accepted when we confirm it in writing.
Unless otherwise stated, our prices exclude VAT and any delivery, travel, accommodation or other charges identified separately in your quotation.
2. Payment
Payment terms will be shown on your quotation or invoice.
We may require a deposit or payment in advance before ordering equipment, configuring your system or beginning content production.
Hardware and other physical goods supplied by us remain our property until they have been paid for in full.
3. Your content
You provide the text, images and other source material from which we create your tinyTour.
You are responsible for ensuring that this information is accurate and that you have the necessary rights and permissions to use the material and allow us to reproduce, translate, adapt and incorporate it into your tinyTour.
You will have an opportunity to review your tour content before the system goes live.
4. Translation and audio
tinyTour includes translation and audio versions of your supplied tour content in the languages specified for your system.
Translation and audio narration may be produced using artificial intelligence and automated services, with appropriate review as part of our content-production process.
You are responsible for checking names, dates, specialist terminology and any wording or pronunciation where particular accuracy is important.
Substantial changes requested after translation or audio production has begun may incur an additional charge.
Where human translation, professional voice recording or other specialist content production is requested, this will be quoted separately unless specifically included in your order.
5. Images and media
The number and type of images, audio files and other media included will depend upon the tinyTour package or specification purchased.
Additional content can normally be added later and may be subject to an additional charge.
You remain responsible for ensuring that you have permission to use photographs, recordings and other media supplied to us.
6. Self-installation systems
Some tinyTour systems are designed for self-installation.
We supply these systems pre-configured together with appropriate instructions. You are responsible for installing and positioning the equipment at your venue and providing the necessary power, Wi-Fi and network infrastructure.
We will provide reasonable assistance with initial setup, but site visits or work outside the supplied installation service may be charged separately.
7. Installed systems
Larger or more complex tinyTour systems may include installation by us.
Where installation is included, you must provide reasonable access to the venue, suitable power and network facilities and any other access or information reasonably required to complete the work.
Travel, mileage, accommodation or other installation expenses will be identified in the quotation where applicable.
8. Wi-Fi and connectivity
tinyTour is designed to minimise its reliance on venue Wi-Fi.
Visitors require Wi-Fi when initially accessing and downloading the tour. Once downloaded, tour content can operate without an ongoing Wi-Fi or mobile-data connection.
Visitors will normally need Bluetooth and Location Services enabled on their device for location-based features.
Some additional services, including tinyTicket, may require access to the venue's local network.
The venue is responsible for providing adequate Wi-Fi, power and network infrastructure where required. We cannot be responsible for the performance or availability of networks and internet services outside our control.
9. Visitor devices
tinyTour is designed to operate on compatible modern smartphones and other supported devices.
Mobile devices, browsers and operating systems change over time. While we aim to maintain broad compatibility, we cannot guarantee that tinyTour will operate on every device or operating-system version.
10. Hardware
Hardware supplied as part of a tinyTour system is covered by the manufacturer's warranty where applicable.
This does not cover accidental damage, misuse, unauthorised modification, unsuitable installation, network or power problems, normal wear and tear, or circumstances outside our reasonable control.
Replacement or additional equipment can normally be supplied and may be charged separately.
11. tinyTicket
tinyTicket is an optional personalised return-pass system that can be supplied alongside tinyTour or as a standalone system.
Where a photograph is taken to create a personalised return pass, it is used solely for producing that pass. The system is designed so that the photograph is not retained after the pass has been produced.
The printed pass is given to the visitor and may contain their photograph for identification when they return.
The venue is responsible for determining the validity period, conditions of use and acceptance of its return passes and for making these conditions clear to visitors.
12. Support and updates
The support, maintenance and content-update services included with your tinyTour system will be set out in your quotation or product specification.
Additional content changes, site visits, replacement hardware or work outside the included support may be charged separately.
We may make reasonable technical changes and software updates where necessary to maintain the security, reliability and compatibility of tinyTour.
13. Intellectual property
You retain ownership of the original text, photographs, recordings and other material you supply to us.
tinyTour retains ownership of its software, system design, templates, documentation, branding and other intellectual property used to create and operate the system.
Purchase of a tinyTour system gives you the right to use the supplied system at the venue and for the purposes agreed with us. It does not transfer ownership of the underlying tinyTour software, technology or intellectual property.
14. Delivery and timescales
We will provide an estimated delivery or installation timescale when your order is confirmed.
Because tinyTour systems are configured and content is prepared specifically for each venue, delivery times may depend upon receiving your completed content and approvals.
We will make reasonable efforts to meet agreed timescales but cannot be responsible for delays caused by suppliers, couriers, late customer content or approvals, or circumstances reasonably outside our control.
Please notify us promptly if equipment arrives damaged or incomplete.
15. Changes, cancellations and refunds
tinyTour systems are prepared specifically for individual venues and may include configured hardware, translation, audio production, content preparation and installation work.
If you cancel an order after work has begun, we reserve the right to charge for work already completed, equipment ordered and other costs we have reasonably incurred or committed to.
Any refund will therefore depend upon the stage the project has reached at the time of cancellation.
If we are unable to fulfil an order, we will refund payments relating to products or services that we are unable to supply.
Nothing in these terms affects rights which cannot legally be excluded.
16. Customer responsibilities
To enable us to provide your tinyTour system, you agree to:
-
provide accurate content and information within reasonable timescales;
-
obtain permission to use material supplied to us;
-
review and approve content when requested;
-
provide suitable Wi-Fi, networking, power and equipment where required; and
-
use the system in accordance with the supplied instructions.
Delays in receiving content, approvals or access may affect the delivery or installation date.
17. Our responsibility
We will provide our products and services with reasonable care and skill.
We are not responsible for problems or losses resulting from inaccurate customer-supplied information, customer networks or equipment, unsupported third-party devices, misuse or modification of the system, or circumstances reasonably outside our control.
Nothing in these Terms & Conditions excludes or limits liability where it would be unlawful to do so.
Subject to this, our total liability arising from an order will not exceed the amount paid to us for the products or services giving rise to the claim.
We will not be liable for indirect or consequential losses, loss of profit, loss of revenue or loss of business opportunity.
18. Privacy
We handle personal information in accordance with our Privacy & Cookies Policy.
tinyTour is designed to minimise the collection of visitor information and does not require visitors to create a tinyTour account or provide personal details simply to use a tour.
19. Changes to these terms
We may update these Terms & Conditions from time to time.
The terms applying to an order will normally be those in effect when we accept that order, unless we agree otherwise in writing.
20. Governing law
These Terms & Conditions are governed by the laws of England and Wales.
The courts of England and Wales will have jurisdiction over any dispute arising from these terms.
